Chapter 1
General provisions

§ 1.

1. The regulations for the use of the E-card in the area of the Intermunicipal Transport Association based in Jastrzębie-Zdrój (hereinafter referred to as the Regulations) specify the conditions of service and check-in of travelers related to its:

  • obtaining;
  • use;
  • top-up;
  • control.

2. The transport of persons, luggage and animals in public transport is specified in separate provisions of the Tariff and in the Order Rules applicable to MZK public transport, which constitute Annex No. 4 to the MZK Tariff.

§ 2.

The Regulations are valid on the premises of the Intermunicipal Transport Association based in Jastrzębie-Zdrój.

§ 3.

Whenever the regulations mention:

MZK - this should be understood as the Inter-municipal Transport Association based in Jastrzębie-Zdrój, providing services in the field of public collective transport in its area of operation;

Season ticket - this should be understood as a ticket entitling a specific person to travel within a specific time period, requiring each trip registration;

Single-use electronic ticket - this should be understood as collecting a fee from the E-card for a single journey or the transport of luggage and animals based on each registration of entry and exit from the vehicle;

Customer Service Office (BOK) - this should be understood as the organizational unit of MZK responsible for accepting applications for the issuance of an E-card, its personalization, issuing an E-card, accepting complaints, selling season tickets or electronic purse top-ups and checking the status of the E-card by users;

Electronic Card (E-card) - a contactless, electronic card that is a carrier of electronic periodic tickets and is an electronic wallet for single-use tickets valid in public transport in the area of operation of MZK;

Contract - this should be understood as electronically saving a season ticket or top-up to an electronic purse on the E-card;

Electronic purse - a service (one-time ticket) activated on the E-card, allowing the accumulation of funds in order to use them to pay fees for single journeys by means of public transport according to the applicable Tariff. The service is active when funds are accumulated on it;

E-card personalization - saving the user's personal data on the E-card, kept at the Customer Service Office;

Top-up contracts - this should be understood as top-up of a purse or purchase of a new season ticket on the electronic card;

Ticket Top-up Point (PDB) - this should be understood as the point of sale of the E-card contract and the place of its top-up;

Top-up Terminal – a place to top up an electronic wallet;

Top-up Validator – a validator in the vehicle with the function of topping up an E-card;

Personalized (personalized) E-card - this should be understood as an E-card that is a carrier of information about the ticket holder's personal data, entitlements to discounts and free travel, and the current contract;

Registration of a journey - validating a ticket when boarding a vehicle - registration of entry - this should be understood as the operation of presenting the E-card to the validator in the vehicle, as a result of which information about the use of the ticket is recorded on the E-card. This operation may be combined with the passenger pressing the appropriate button on the device;

Registration of leaving the vehicle - this should be understood as the operation of presenting the E-card to the validator when leaving the vehicle, performed after prior registration of the journey;

Deposit - this should be understood as the fee charged to the applicant for issuing a duplicate personal E-card;

Card Top-Up Service (SDK) - an online service within the website www.mzkjastrzebie.com enabling the purchase of a ticket;

Top-up - purchase of electronic tickets and points to pay for travel;

Agreement - ordering a ticket selected by the Customer and confirmation by MZK of the execution of the order in the form indicated in these Regulations;

Transfer service - saving an electronic ticket purchased using the SDK to an E-card using a reader in an MZK vehicle;

OPE – Electronic Payments Operator.

§ 4.

The e-card is the property of the Intermunicipal Transport Association based in Jastrzębie-Zdrój.

Chapter 2
Obtaining an E-card

§ 5.

The e-card is issued to users - adults or minors, in compliance with the provisions of § 9.

§ 6.

The e-card can be issued as a personal card or as an electronic wallet.

§ 7.

  1. A personal e-card is issued to the user in accordance with § 10-14 and after purchasing any season ticket recorded on the e-card, and in the case of an electronic purse - after the first top-up with an amount of not less than PLN 10 - excluding persons entitled to free travel.
  2. Subsequent top-ups can be made at Customer Service Centres, PDB, Top-up Terminals or Top-up Validators.

§ 8.

  1. The e-card may be saved on a student ID or another card configured in accordance with the System requirements, subject to section 2
  2. If a season ticket or an electronic purse top-up is saved on a personal card without a photo, other than an E-card, the passenger is obliged to have a document confirming his/her identity.
  3. Saving a season ticket or topping up an electronic purse on a configured card other than an E-card takes place in the E-card issuance mode.

§ 9.

  1. Subject to section 2, the personal e-card is issued on the basis of a written application from:
    a) an adult person;
    b) a minor who is over 13 years of age - with the consent of the statutory representative or guardian of the partially incapacitated person;
    c) a legal representative of a minor who is under 13 years of age or legal guardians of completely incapacitated persons - hereinafter referred to as the applicant.
  2. E-cards are not issued to children under 4 years of age

§ 10.

The application for issuing an E-card can be downloaded from the Customer Service Office (Customer Service Office), PDB or from the MZK website http://www.mzkjastrzebie.com .

§ 11.

  1. An application for an E-card must be submitted, in compliance with § 9, to the CC, which verifies the data contained in the application and confirms the entitlement to discounts or free travel.
  2. An incomplete or incorrectly completed E-card application will not be considered
  3. Personal data included in the application for issuing an E-card are subject to MZK records in accordance with the provisions on the protection of personal data

§ 12.

  1. In order to issue a personal E-card, the applicant is obliged to contact the CC
  2. To obtain a personal E-card, the following documents must be presented:
    a) a document with a photo confirming the identity of the applicant;
    b) completed application for issuing an E-card;
    c) PESEL number of the E-card user;
    d) current photo (35x45mm);
    e) documents confirming the type of relief and its duration in accordance with separate regulations;
    f) a document confirming the authority to represent the persons referred to in § 9 section 1 point b and c.
  3. The personal e-card contains the following data:
    a) name and surname of the holder;
    b) residential address;
    c) PESEL number;
    d) photo of the ticket holder;
    e) entered entitlement to the discount in the case of reduced tickets;
    f) current contract.

4. The photo referred to in section 2 point d, is refundable after personalizing the E-card.

§ 13.

  1. The applicant is obliged to collect the personal e-card in accordance with § 12 at Customer Service Office no later than within 30 days and no earlier than within 5 business days from the date of submitting the application.
  2. In particularly justified cases, it is allowed to send an E-card authorizing free travel to the address indicated in the application
  3. Unclaimed E-cards within 1 year of submitting the application will be physically liquidated and applicants' data will be deleted from the E-card system.

§ 14.

  1. The applicant is obliged to report each change of personal data (including surname, name, address) to BOK in order to update the personal data contained in the personal E-card.
  2. The data on the personal E-card is updated in the mode of issuing a personal E-card

§ 15.

A new personal E-card of the same type may be issued in the case of:

  1. destruction or damage to the E-card,
  2. loss or theft of the E-card.
A non-refundable deposit of PLN 10 is charged for issuing a duplicate personal E-card.

§ 16.

  1. The loss of a personalized E-card due to its loss or theft should be reported by phone, electronically or in person to Customer Service in order to complete a card loss report. Reports can be submitted during BOK opening hours.
  2. The lost E-card will be blocked:
    • the next business day if reported before 4 p.m. on a business day
    • up to 36 hours in other cases, except holidays
  3. A blocked E-card can be unblocked, except when the E-card is brought close to the validator/reader after it has been blocked.

§ 17.

  1. MZK is not responsible for losses of funds accumulated on the E-card from the moment of reporting the loss of the E-card until the E-card is blocked.
  2. The remaining travel limits on season tickets from the lost personal E-card will be transferred to the duplicate E-card according to the E-card balances from the next business day after it is blocked.
  3. Funds saved in the electronic purse from the lost personal E-card will be transferred to a duplicate E-card according to the E-card balance from the next business day after it is blocked.

§ 18.

An e-card with a disclosed manufacturing defect is replaced free of charge.

§ 19.

Cancellation and amendment of the contract

  1. In justified cases, a contract saved on a personalized E-card can be canceled at Customer Service Center no later than the 5th day from the date of its commencement.
  2. The contract reimbursement amount is calculated in proportion to the period of use.
  3. The contract can be canceled upon written request by deleting information about the saved contract from the E-card. The E-card can only be returned to the Customer Service Office.
  4. The complaint rules are included in Annex 1 to the Regulations.

Chapter 3
Using the E-card

§ 20.

A personal e-card may only be used by the person whose data has been recorded on it.

§ 21.

  1. The electronic purse is active when points are accumulated on it and is valid until the accumulated points are used, but no longer than for a period of 36 months from its last top-up.
  2. The validity of the electronic wallet is extended by another top-up

§ 22.

The rules for the proper use of the E-card are established:

  1. The e-card must not be broken, bent or mechanically damaged in any other way (e.g. punching, cutting);
  2. The e-card should not be exposed to high and low temperatures, as well as chemicals and strong magnetic or electric fields;
  3. The e-card must be stored and used safely.

§ 23.

The expiry of the validity date of the entitlements to discounted travel from the electronic purse recorded on the personal E-card will not be signaled. When registering the journey, the validator/reader will collect the fee as for a normal journey.

Chapter 4
E-card operation

§ 24.

  1. The validator is used for:
    • charging a fee from an electronic wallet for a single journey or the transport of luggage or animals based on registration of entry and exit from the vehicle
    • registration of travel on the basis of a season or free ticket
    • top-up E-card in the case of top-up validators
  2. All types of E-cards are subject to the obligation to register the E-card (i.e. "valise" using electronic ticket validators) on an MZK bus.
  3. The validator collects the following automatically from the E-card: normal fare, reduced fare or only records the journey

§ 25.

When using an E-card with an electronic purse contract, you should:

  1. when entering the vehicle, present the E-card to the validator to register the journey;
  2. when leaving, you must present the E-card again to the validator to register your exit from the vehicle;
  3. at the time of registration of exit from the vehicle, the difference between the advance fee charged for driving to the end of the route and the fee due for the ride to the stop where the passenger actually got off will be refunded. Registration of exit is a necessary condition to benefit from the lower fare.

§ 26.

  1. When using an E-card with a season ticket contract or free travel entitlement, when entering the vehicle, present the E-card to the validator in order to register the journey.
  2. Each additional trip registration (for other people or luggage) beyond your trip requires additional trip registration
  3. In order to register a journey using an electronic wallet, the E-card must contain funds not less than the value of the fare in accordance with the tariff applicable on a given line until the end of its route.

§ 27.

In the case of a personal E-card, the validator automatically records the journey based on the season ticket or collects the fee from the electronic wallet.

§ 28.

If you use an electronic wallet while traveling from the same stop on the same bus, you can pay for a maximum of 16 people, i.e. for the card holder and up to 15 fees for co-passengers.

§ 29.

Two different periodic contracts and an electronic wallet can be saved on the E-card at the same time.

§ thirty.

  1. If you use an E-card with two saved contracts, a periodic one and an electronic purse, the system will first use the season ticket valid on a given day saved on the E-card.
  2. If the season ticket encoded on the E-card has expired or the travel limit of the season ticket has been exhausted, the validator attempts to validate the electronic ticket from the electronic purse without warning.

Chapter 5
E-card top-up

§ 31.

  1. The E-card may contain entitlements to reduced or free travel upon presentation of a valid document entitling to such discounts. These rights are valid until the end of the validity period of this document.
  2. Before the expiry date of the document entitling you to a discount or free travel, you must present to Customer Service a document authorizing you to continue using the entitlement.
  3. In the event of failure to submit the document specified in section 2, E-card will automatically be saved as normal

§ 32.

  1. E-card top-up takes place:
    • in the case of an electronic purse: at Customer Service Centers, at Ticket Top-up Points and at Top-up Terminals. Top-up via top-up validators on all MZK buses is only possible if you have previously purchased a ticket via an individual online account
    • in the case of an E-season card: at Customer Service Centres, Ticket Top-Up Points. Top-up via top-up validators on all MZK buses is only possible if you have previously purchased a ticket via an individual online account
  2. If you top up at BOK, you can pay by payment or credit card
  3. The amount to top up the electronic wallet cannot be lower than PLN 10

§ 33.

Each time the E-card is topped up, with the exception of Top-Up Validators, a receipt is issued, which is the basis for filing a possible complaint.

§ 34.

  1. The sum of points accumulated on the electronic purse is limited and cannot exceed 250 points worth PLN 250.00
  2. Points accumulated on the electronic purse may be used until the E-card or these points expire or are blocked.

§ 35.

Detailed activities related to topping up the E-card via the Internet are specified in the Regulations for topping up the E-card via the website and its validation and top-up on buses, which constitute Annex No. 2 to these Regulations.

Chapter 6
e-Card control

§ 36.

E-card inspections can only be carried out by designated MZK employees and persons from specialized companies commissioned by MZK, with an ID badge placed in a visible place.

§ 37.

An e-card without a registered trip or a receipt alone does not entitle you to travel.

§ 38.

During the inspection, the passenger provides the E-card to the inspector in order to read its contents.

§ 39.

  1. The controller is equipped with a device for controlling E-cards, hereinafter referred to as the controller reader
  2. The screen of the controller's reader with the result of the control displays basic data regarding the registration of the journey on a given course, data regarding the E-card and the tickets saved on it.
  3. The reader signals the control result with sound:
    a) single sound signal - at least one trip registration has been made on a given course;
    b) triple sound signal - no registration of the journey on a given course or no contract whatsoever.

§ 40.

If the E-card is blocked or the inspected passenger is unable to confirm the right to use the E-card, the controller has the right to retain the E-card and forward it to Customer Service for clarification.

§ 41.

In the absence of a valid season ticket and no registered validations from the electronic wallet, the controller issues an additional fee form with a request for payment in accordance with separate regulations.

Annex No. 2 to the Regulations on the use of the E-card

E-card complaint rules

I. Cancellation of the E-card

  1. Cancellation of the E-card can only be made at the Customer Service Office
  2. The basis for resignation is a valid E-card, a completed application to resign from the E-card and an identity card
  3. The application is verified (checking the online account balance and other necessary data) within 24 hours of its submission
  4. If funds are found in the applicant's account, the amount is paid at the Customer Service Office or transferred to the applicant's indicated account (applies to a personal e-card).
  5. The applicant's card is physically liquidated

II. Change of contract

  1. The basis for changing the contract is a valid E-card, a completed complaint form and a fiscal receipt or online confirmation of the transaction. In the absence of confirmation, the complaint cannot be accepted.
  2. A change to the contract that has been purchased and saved on the E-card may be made at the Customer Service Office.
  3. A change to a contract that has been purchased and has not been saved on the E-card (contract purchased through the Card Top-Up Service) may be made at the Customer Service Office or via the online Card Top-up Service.
  4. If the contract encoded on the E-card is found to be inconsistent with the expected contract, the Customer has the right to file a complaint only at the point of sale where the purchase was made, until the end of the operation of that point on the day of purchase. If the next day has started, a complaint may only be accepted at the Customer Service Office.
  5. If the value of the new contract is lower than the value of the complained contract, the price difference is refunded to the Client and the change is confirmed.
  6. If the value of the new contract is greater than the value of the complained contract, the price difference is charged to the Customer and the change is then confirmed.
  7. If the Client complains about the validity of a coded contract, a new expiration date is entered and the change is then confirmed
  8. New sales are fiscalized
  9. The receipt of the complained transaction is attached to the application, which constitutes an explanation for the Tax Office

III. Cancellation of the contract

  1. The basis for canceling the contract is a valid E-card, a completed application and a fiscal receipt or online confirmation of the transaction
  2. Only the 30-day contract and its multiples are subject to contract cancellation
  3. Cancellation can only be made at the Customer Service Office
  4. The contract can be canceled no later than the 5th day from the date of its commencement
  5. After canceling the contract, the amount calculated in proportion to the period of use of the E-card is refunded
  6. After completing the complaint procedure, the original complaint documentation is archived in MZK

IV. Loss of E-card

  1. Reporting the loss of a personalized E-card due to its loss or theft should be made by phone, electronically or in person at Customer Service in order to complete a card loss report. Reports can be submitted during BOK opening hours.
  2. The lost E-card will be blocked:
    • the next business day if reported before 4 p.m. on a business day
    • up to 36 hours in other cases, except holidays
  3. A blocked E-card can be unblocked, except when the E-card is brought close to the validator/reader after it has been blocked.
  4. A new personal E-card of the same type may be issued on the basis of a completed application, an identity document with a fiscal receipt or online transaction confirmation.
  5. If the Customer does not have an appropriate identity document or fiscal receipt or if it is destroyed in a way that makes it impossible to read the information contained on it, the complaint cannot be accepted.
  6. A new E-card will be personalized and issued within 24 hours of submitting a complete application
  7. A non-refundable deposit of PLN 10 is charged for issuing a duplicate personal E-card.
  8. A new E-card together with a recreated Contract and a fiscal receipt can only be issued to the owner with an appropriate identity document (ID card, passport, driving license). If the owner of the E-card is a minor, parents and/or legal guardians are authorized to collect it.
