I. RULES FOR RECHARGEING AN E-CARD VIA THE WEBSITE (SDK)

§ 1.

Card top-up service via the website

  1. MZK provides a top-up service within the meaning of the Act of July 18, 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended).
  2. Available forms of payment for top-up are bank transfers and payment by payment card

§ 2.

Terms of concluding a contract for the provision of electronic services

  1. The Agreement is concluded via the SDK website
  2. The conclusion of the Agreement is not possible if the Customer does not confirm that he or she has read and accepted the Regulations

§ 3.

Providing the service electronically

  1. The condition for the implementation of the transfer service is the receipt of the top-up funds on the settlement account indicated by MZK, including the transaction code obtained in SDK in the transfer title.
  2. The transfer service using a validator in MZK vehicles will be available after min. 3 hours from registering the payment in the system. The impact of the top-up funds on the settlement account indicated by MZK on the SDK website will be confirmed by information sent to the Customer's e-mail address.
  3. With one top-up, you can purchase one selected season ticket or purchase points intended to be used to pay for single journeys in public transport vehicles.
  4. Each top-up service and transfer can be confirmed by printing out a website on which information about the transfer is presented
  5. In order to receive a VAT invoice for the ticket purchased as part of the top-up, the Customer should contact BOK within 7 days from the date of the transfer service.
  6. By providing personal data, the Customer consents to the inclusion and processing of the provided personal data in the personal data file. The data is processed only for top-up purposes. Additionally, in accordance with Art. 24 section 1 of the Act of August 29, 1997 on the protection of personal data, Journal of Laws of 2002, No. 101, item 926 as amended:
    • the administrator of data transferred as a result of using the SDK is the Director of MZK,
    • personal data will be processed for the purpose of providing services offered by SDK and will not be made available to other recipients,
    • The customer has the right to access his data, correct it and consent to its processing.

§ 4.

Registration and purchase process

  1. The condition for purchasing a ticket is that the Customer must correctly enter the data required by the SDK
  2. A customer who intends to use the SDK for the first time should:
    • register on the Website by entering in the registration form: PESEL
      E-Card number
      provided in the application for the E-card,
      password,
      e-mail address
    • accept the Regulations using the checkbox labeled "Accept" located on the SDK registration page
    • After receiving an automatic e-mail confirming registration on the website, the Customer should click on the link in the received e-mail to activate his account in the SDK
  3. If the SDK regulations change, the Customer is obliged to accept the amended Regulations
  4. The customer can purchase a ticket or check the history of the E-Card after logging in to his or her individual account. To log in, you must enter the card number and password provided during registration.
  5. The customer purchases the first season ticket at BOK. In the SDK, the Customer can purchase another ticket compatible with the previous one. In the event of a change in ticket parameters, please contact Customer Service.
  6. Information about the course of the transaction, including: a unique transaction identifier, as well as information about the details of the purchase, will be sent by MZK to the e-mail address provided by the Customer when registering for SDK.
  7. When the payment process is successfully completed, the Customer is sent an e-mail by OPE confirming that the payment for the ticket has been credited. The ticket purchase is finalized at this point.

§ 5.

Ticket payment

  1. The ticket price is specified in Polish zlotys (PLN) and includes VAT
  2. Ticket types and prices are determined by the MZK Meeting
  3. The customer pays for the ticket using one of the available payment methods:
    • payment card - payment made via OPE
    • quick transfer - payment service by quick transfer from any bank providing this type of service, payment made via OPE
  4. When making a payment, the Customer must have a payment card or an account in a bank supporting the quick transfer service via OPE and sufficient funds to pay for the ticket.
  5. The transaction in which one of the possible payment methods is not selected will be canceled
  6. The Seller is not responsible for the consequences of providing the payment card number and bank account number by the Customer on other websites. OPE is responsible for the execution and security of transactions made by payment cards or quick transfers carried out on OPE's websites.
  7. OPE is not a party to or in any other way subject to the legal effects of the Purchase Agreement
  8. OPE is not a party to, or in any other way covered by the legal consequences of, the Agreement concluded by the Client with the bank, under which the Client, through the bank, makes funds available to OPE for the purpose of paying MZK.
  9. OPE shall not be liable to the Customer for the proper performance of the bank's obligations, in particular for the bank's transfer of funds to OPE on the appropriate date, amount and with appropriate data identifying the funds.

§ 6.

Customer rights and obligations

  1. The client is obliged to:
    • use the SDK in accordance with the provisions of law, the provisions of these Regulations and good practices
    • not to transfer the rights arising from the conclusion of the Agreement to third parties
    • provide true personal data, payment details by payment card or quick transfer
    • do not use the SDK to commit illegal acts
  2. The Customer declares that all information provided by him when using the SDK is true and true to the best of his knowledge
  3. MZK has the right to withdraw from the Agreement if the Customer violates these Regulations, in particular providing incorrect personal data or data regarding a payment card or quick transfer.
  4. The Client declares that he is aware of the civil law and criminal law consequences of actions inconsistent with the legal order in force in Poland, and acknowledges that the relevant law enforcement authorities will be informed about actions that constitute an act punishable by law (hacking, fraud, etc.), which does not exclude seeking compensation for the damage in civil proceedings.

§ 7.

Complaints

  1. Complaints regarding online top-ups can be submitted in writing to the MZK address or MZK e-mail address.
  2. The subject of the complaint is the failure or improper performance of the top-up or transfer service by MZK
  3. The service recipient may submit complaints within 5 days from the date of the event that is the subject of the complaint
  4. The basis for a complaint cannot be:
    • the fact that the top-up concerns an E-card incorrectly indicated by the Customer
    • citing circumstances related to the incorrect functioning of a web browser or telecommunications connections
    • other circumstances related to the activities of entities for whose activities MZK is not responsible
  5. The complaint should include the Customer's data, including correspondence address, card number and description of the objections raised, and telephone number in case of the need to supplement the complaint.
  6. If the data or information provided in the complaint need to be supplemented, MZK asks for them to be supplemented before considering the complaint. Failure to complete the form within 7 days of the request will result in the complaint not being considered.
  7. MZK considers complaints within a maximum of 14 days from the date of receipt or supplementation
  8. If it is impossible to consider the complaint within the above deadline, MZK informs the person filing the complaint, stating the reason for extending the deadline and the expected response time.

§ 8.

Reservations

  1. MZK reserves the right to temporarily suspend access to the SDK in order to carry out maintenance work. Information about the lack of access to the service will be published on the website.
  2. MZK reserves the right not to accept or reject the top-up and to refuse to process the top-up. In such a case, MZK will notify the Customer about the refusal and its reason.
  3. Top-up requests that are incorrectly defined or those that cannot be confirmed may not be processed and the funds paid will be returned to the Service User.
  4. MZK is not liable for non-performance or improper performance of obligations arising from these Regulations, unless the non-performance or improper performance of obligations is caused by circumstances that MZK had no influence on despite exercising due diligence (force majeure) or solely due to the fault of the injured party or a third party. In the event of force majeure, the provision of the Service will be suspended for a period equal to the period of force majeure.

II. RULES FOR VALIDATING AND TOP-UPING E-CARDS IN MZK BUSES

§ 9.

All types of E-cards are subject to the obligation to register the E-card (i.e. "valise" using electronic ticket validators) on an MZK bus.

§ 10.

The validator collects the following automatically from the E-card: normal fare, reduced fare or only records the journey.

§ 11.

The validator has three keys enabling:
N - normal ticket, topping up for other people, luggage, dog
U - reduced ticket, topping up for other people entitled to a discount
and - displaying information about tickets held, cash on an electronic purse, transferring top-up funds to E -card.

§ 12.

Registration (validation) of a personal E-card for season tickets

The e-card should be presented to one of the validators each time you enter the bus without pressing any of the keys. The trip will be automatically registered. When leaving the vehicle, do not bring the E-card closer to the reader. If you need to pay for a co-passenger, dog or luggage, the electronic purse contract should be written on the E-card. The rules for recording additional toll charges are described below.

§ 13.

Registration (deleting) of the electronic purse e-card

To register (delete) a trip:

  • in the case of a normal ticket, present the E-card to the validator without pressing any of the keys - the journey will be automatically registered
  • in the case of a reduced fare, press the "U" key (concession fare) before presenting the E-card to one of the validators. In the case of personalized E-cards with the discount entitlement saved, the passenger does not have to press the key because the validator will automatically collect the discount fee.
  • when paying for a co-passenger(s), dog or luggage, press one of the "N" or "U" buttons and bring the E-card closer to the reader again. We repeat this step each time we need to purchase more fees.

The red light on the validator and a single sound signal indicate that the trip has been registered. The display will show the amount of the fee charged and the current balance of the E-card account. If the light or sound signal does not come on, press the "i" button and bring the E-card closer to the validator reader. A message will appear on the display informing whether the E-card has been deleted.

When validating the E-card for single-use tickets, the maximum fee specified in the tariff will be charged up to the last stop of the journey.

Attention

When getting off, you need to present the E-card again to one of the ticket validators to deregister your journey. If we travel on a shorter distance, we will be refunded the amount of the unused journey.

If you do not register to leave the vehicle, the fee for the unused journey will not be refunded.

The checkout operations can be repeated when paying for a trip for a maximum of 15 people (luggage, animals).

Persons traveling with the E-card user for whom the fee has been paid have a paid trip on the same section as the E-card user.

§ 14.

Top-up E-card (season ticket or electronic purse)

To top up your E-card, please:

  • have a personalized E-card
  • have an online E-card top-up account
  • press the "i" button twice and then insert the E-card into the pocket of one of the top-up validators. The previously purchased service will be saved on the card. After this operation, take out the E-card and hold it close to the validator's reader to register the journey.

§ 15.

Checking the E-card top-up status

To check the status of the E-card, when getting on the bus, press the "i" button of one of the validators and then bring the E-card close to the validator's reader. Information about the E-card status will appear on the display. The red light will come on and the validator will emit a double beep.

Pressing the "N" or "U" key causes the validator to be ready for approximately 5 seconds to collect a one-time value for the ticket, depending on the key pressed. The addition operation is one-time. Once completed, the validator returns to normal operation mode.

The validator validates the ticket according to the tariff and type of ticket specified in the E-card. Topping up is possible after selecting the type of additional ticket again.

After 5 seconds from selecting validation, if no E-card has been applied to the validator, the validator returns to the normal operation mode.

Pressing the "i" key takes you to the E-card account balance checking mode. Each key press cancels the previously selected option and selects a new one.

The validator has a cancellation lock function, activated by the driver from the control panel or by the Controller's E-card. The locked status of the validator is indicated by an appropriate message on the display and the red light on the validator turns on.

§ 16.

  1. All messages on the validator display are displayed as long as the E-card is held against its reader. After removing the E-card from the validator, it returns to normal operation mode.
  2. If the E-card is removed from the validator too quickly, so that it is not certain whether the validation has been performed correctly, the passenger will receive a message on the display to check the operation status. In this case, check the operation status by pressing the "i" key. If the deletion or deletion operation was performed correctly (message displayed on the validator display), there is no need to register again.
  3. The following situations are indicated by the illumination of the red light, three beeps and an appropriate message:
    • expiration of the E-card expiration date
    • blocking the E-card
    • placing the E-card on the "blacklist"
    • no valid season tickets
    • lack of funds on the E-card enabling the trip
    • "uncertain" trip registration operation
    • other emergency situations that prevent the trip from being recorded
The above means that the trip has not been registered. In this case, the passenger is obliged to purchase a single-use paper ticket from the driver. Cards from outside the System are ignored.

§ 17.

The expiry of the expiry date of discounted travel entitlements will not be signaled in a special way. The validator will collect the fee as for a normal journey.

§ 18.

The zero balance of the E-card account does not allow it to be deleted. An attempt to make an additional deletion or deletion on another line will result in the lack of funds being signaled by the red light turning on, a triple sound signal and the display of the appropriate message: "No points".

§ 19.

The e-card is controlled and allows identification of the user, the discount they are entitled to and the area for which it is valid.

§ 20.

Final Provisions

  1. The complaint procedure is specified in separate provisions contained in the Complaints Regulations
  2. These Regulations are made available via the website at www.mzkjastrzebie.com
  3. The amendment to the Regulations shall enter into force no later than five days after the amended Regulations are made available via the website at www.mzkjastrzebie.com. Services ordered before the amendment to the Regulations will be provided on the terms and conditions specified at the time the payment was recorded by MZK.
